REGULATION OF THE MINISTER OF MARINE AFFAIRS AND FISHERIES

CONCERNING
STIPULATION OF SUMATERA AS QUARANTINE AREA FOR COMMON CARP AND KOI
Considering :
- a. that as a follow up of Article 53 paragraph (1) of the Government Regulation No. 15/2002 concerning Fish Quarantine, then in the framework of overcoming the infection of Koi Herpes Virus disease in Common Carp and Koi in Sumatera area, it is considered necessary to stipulate Sumatera As Quarantine Area For Common Carp and Koi;
- b. That in the connection with the above mentioned fact it is necessary to lay down a Ministerial Regulation.

- 2. Law No. 31/2004 concerning Fisheries;
- 3. Law No. 32/2004 concerning Local Government;
- 4. Government Regulation No. 15/2002 concerning Fish Quarantine;
- 5. Presidential Decree No. 102/2001 on Status, Tasks, Functions, Authority, Organizational Structures And Working System of Ministries, as already amended by Presidential Decree No. 45/2004;
- 6. Presidential Decree No. 109/2001 concerning Organization Unit and Tasks of Echelon I in Ministry, as already amended by Presidential Decree No. 36/2004;
- 7. Presidential Decree No. 187/M/2004;
- 8. Decree of Minister of Marine Affairs and Fisheries No. 24/MEN/2002 concerning Systematization and Arrangement of Regulations within Ministry of Marine Affairs and Fisheries;
- 9. Decree of the Minister of Marine Affairs and Fisheries No. KEP.05/MEN/2003 concerning Organization and Work System of the Ministry of Marine Affairs and Fisheries;

- 12. Decree of the Minister of Marine Affairs and Fisheries No. KEP.32/MEN/2004 concerning Organization and Work System of the Technical Executive Unit of Fish Quarantine.
DECIDES :
To Stipulate :
REGULATION OF THE MINISTER OF MARINE AFFAIRS AND FISHERIES CONCERNING STIPULATION OF SUMATERA AS QUARANTINE AREA FOR COMMON CARP AND KOI.
FIRST :
Define the region of Sumatra as a quarantine area for Goldfish and Koi.
SECOND :
Upon stipulation of Sumatera As Quarantine Area For Common Carp and Koi as meant in FIRST Dictum, then:
- a. it is prohibited to import and/or export Common Carp and Koi into and from Sumatera Island,
- b. development and control and eradication of Koi Herpes Virus disease is conducted.
THIRD :
If the efforts of development and control and eradication of Koi Herpes Virus disease as meant in SECOND dictum is successful and no more Koi Herpes Virus disease found for 2 (two) years consecutively, then the Minister shall revoke the quarantine area status and stipulate it to become free area.
FOURTH :
For smooth Implementation of this Regulation, then:
- a. The Director General of Cultivated Fishery is obliged to issue Implementing Guidelines of control and eradication of Koi Herpes Virus disease;
- b. Governors and Regents/Mayors shall control and eradicate Koi Herpes Virus disease in accordance with the Implementing Guidelines issued by the Director General of Cultivated Fishery.
FIFTH :
These Regulations shall come into force on the date specified.
